Article 1 (Purpose)
These Terms are intended to define the rights, obligations, and responsibilities of the Company and users in connection with the use of the shared-album service “MoMoAlbum” (the “Service”) provided by MoMoAlbum (the “Company”).
Article 2 (Definitions)
- “Service” means the mobile application and related services through which users upload photos and videos by album, view and communicate with invited members, and use additional features such as subscriptions and printing.
- “Album” means a space created by a user where members are invited to share content.
- “Member” means a user who participates in a particular album through an invitation or other means.
- “Content” means all information, including photos, videos, and comments, posted by a user on the Service.
Article 3 (Posting and Amendment of the Terms)
- The Company posts these Terms within the Service or on a linked screen.
- The Company may amend these Terms to the extent that doing so does not violate applicable laws. When amending them, the Company announces the effective date and reasons for the amendment from 7 days before the effective date (30 days before for changes unfavorable to users).
Article 4 (Accounts and the Service Agreement)
- The service agreement is formed when a user agrees to these Terms, applies to sign up with a social account such as Kakao, Naver, Google, or Apple, and the Company accepts the application.
- Persons under 14 years of age may not use the Service.
- An account may be used only by its owner and may not be transferred or lent to a third party.
Article 5 (Service Content and Changes)
- The Company provides features such as shared albums, timelines, comments and reactions, invitations, recaps, and search.
- The Company may change all or part of the Service when necessary for operational or technical reasons, and announces material changes in advance.
- Some features, including photo printing and photobook orders, are available only in the Republic of Korea.
Article 6 (Paid Services — Subscription)
- A “Group Pro” subscription is an automatically renewing product paid for through an in-app purchase on the Apple App Store or Google Play, and its benefits apply to all members of the album to which the paying member belongs.
- The subscription price and period are shown on the payment screen. Unless canceled, the subscription renews for the same period.
- Cancellation and refunds follow the policies and procedures of each store (App Store/Google Play). When canceled, benefits remain available until the already-paid period ends.
Article 7 (Paid Services — Photo Prints and Photobooks)
- Photo prints and photobooks are individual-order products for which the amount shown at checkout (product price plus shipping) is paid, separate from the subscription.
- Payment and refunds are processed through PortOne V2, and production and delivery are entrusted to a professional printing company.
- Because the ordered product is a custom-made product produced with the user's photos, the right to withdraw from the contract (cancellation and refund) may be restricted after production (printing) begins pursuant to Article 17(2) of the Act on the Consumer Protection in Electronic Commerce, etc. A full refund is available before production begins.
- For defective or incorrectly delivered products, contact customer support within 7 days of receipt and we will reproduce the product or issue a refund.
Article 8 (Rights in Content)
- Copyright in content posted by a user belongs to that user.
- The user permits the Company to use the content to the extent necessary to provide the Service, including storage, encoding, thumbnail generation, display to album members, and production of photo prints and photobooks requested by the user.
- Users must post only content that does not infringe another person's portrait rights, copyright, or other rights. The user is responsible for any resulting liability.
- Content posted in an album is disclosed to the members of that album. Please keep this in mind when inviting members.
Article 9 (Prohibited Acts)
Users must not engage in the following acts, and use of the Service may be restricted for violations.
- Stealing another person's account or registering false information
- Posting obscene, violent, hateful, or rights-infringing content
- Interfering with normal operation of the Service, including unauthorized crawling and reverse engineering
- Unauthorized commercial advertising or spam
Article 10 (Management of Posts)
- The Company may take measures such as suspending or deleting content that violates applicable laws or these Terms.
- Users may report violating content through the reporting feature in the Service.
Article 11 (Termination and Withdrawal)
- Users may terminate the service agreement at any time through [Settings → Account Management → Delete Account] in the app.
- Upon withdrawal, content uploaded by the user and account information are deleted in accordance with the Privacy Policy and cannot be recovered.
Article 12 (Limitation of Liability)
- The Company is not liable for service interruptions caused by force majeure, such as natural disasters or telecommunications failures.
- The Company does not intervene in disputes between users or between a user and a third party arising through content, and is not liable for resulting damages.
- The Company is not liable for the use of the Service provided free of charge unless applicable law provides otherwise.
Article 13 (Governing Law and Jurisdiction)
These Terms are interpreted under the laws of the Republic of Korea. Disputes related to use of the Service shall be brought before the court having jurisdiction under the Civil Procedure Act.
